OPINION | The House Sets the Rules: What lies ahead for gaming in India

The draft rules envisioned the Online Gaming Authority of India as largely an administrative body, a registration window with some adjudicatory powers. The final rules build something closer to a sector regulator with quasi-judicial muscle. The Rules explicitly bind the Authority to principles of natural justice and give it powers to summon persons, examine them, and inspect data, books, and documents. The Appellate Authority, i.e., the Secretary of MeitY, has the power to call for records suo motu and examine the legality of the Authority’s decisions, even without an appeal being filed.
