The article discusses the legal ambiguity surrounding India’s gig economy, comprising workers like drivers and delivery personnel, and the lack of clear laws governing their employment and social security benefits. Despite central and state laws being enacted to recognize and protect these workers, they remain largely unenforced or partially implemented. The judiciary is currently dealing with cases related to gig workers’ rights, and the Supreme Court’s decision in a pending case may bring much-needed clarity on their status. The article suggests that authorities could draw inspiration from the Motor Vehicle Aggregator Guidelines, 2025, which provide benefits to drivers, to strike a balance between traditional employment relationships and new-age work arrangements, ultimately creating modern and equitable working relationships.
