JSA Advocates & Solicitors successfully represented GlobalLogic Technologies Private Limited before the Hon’ble High Court of Delhi in setting aside an injunction that had restrained the termination of a commercial contract.
The Court categorically held that where a contract is determinable in nature, equitable relief in the form of an injunction is not maintainable, and any alleged loss can only be compensated by way of damages. By staying the injunction, the Court reaffirmed the settled position that termination of commercial contracts cannot be specifically enforced.
