Military AI is a critical element of defense modernization plans worldwide, with applications ranging from autonomous drones to data analysis and logistics. Authors Zain Pandit and Aashna Nahar from JSA Advocates and Solicitors highlight that major powers like the US and China are investing heavily in military AI. India’s defense ministry has established bodies like the Defence AI Council (DAIC) and Defence AI Project Agency (DAIPA) to guide AI adoption, with a focus on reliability, safety, transparency, fairness, and privacy through the ETAI Framework. Challenges include ensuring transparency in AI decision-making, compliance with International Humanitarian Law, inter-agency coordination, and limited computational resources and data ecosystems. With the right investments, India can emerge as a leader in responsible defense AI innovation.
