Data Protection Bill, 2021: Paradigm shift in compliance

India’s data protection regime has been long overdue for a meaningful overhaul that accounts for adequate protection of citizens’ personal data while also facilitating the data flows that form the basis of all modern commerce and trade.

The Personal Data Protection Bill, 2019 (“PDP Bill, 2019”) was introduced in the Lok Sabha by theMinistry of Electronics and Information Technology in December 2019 and was subsequently referred to a Joint Parliamentary Committee (“JPC”) for re-consideration ofseveral contentious clauses. Post extensive stakeholder consultations, the JPC submitted its report (“JPC Report”) in December 2021 that includes the recommendations of the JPC along with the draft bill, now titled the Data Protection Bill, 2021 (“DP Bill”), which is likely to be re-introduced this year and implemented in a phased manner.
