Pragya Chauhan

Pragya’s core area of practice is Arbitration and Commercial Litigation. She specializes in disputes in the Construction & Engineering and Information Technology Services sectors.

She has successfully represented clients in around 50 domestic and international commercial arbitrations with awards of more than hundreds of crores being passed in favor of the client.

In addition to arbitrations, Pragya also regularly handles high value commercial matters before the Supreme Court and various High Courts. She has significant experience in company & shareholder disputes and has represented clients before the National Company Law Tribunal & National Company Law Appellate Tribunal.

Pragya has been practicing law since 2012. She has been with JSA since the inception.

Some of the key assignments in these areas handled and being handled by Pragya amongst others, cover the following:

  • Successfully represented a leading IT/ITES company in arbitration proceedings against a statutory body in relation to disputes arising out of its contracts for implementing e-governance. The value of claims awarded exceeded INR 550 crores. Counter-claims of more than INR 200 crores raised by the counter party were also rejected by the tribunal.
  • Successfully represented one of India’s largest Engineering & Construction Company in arbitration proceedings pertaining to disputes arising out of an EPC Contract for construction of a Thermal Power Project. The value of claims awarded exceeded INR 1000 crores. Counter-claims of about INR 1200 crores raised by the counter party were also rejected by the tribunal.
  • Represented a leading US based energy technology company in two connected international commercial arbitration proceedings arising out of termination of contracts for Supply of Goods and Equipments and Services for development of oil field in Rajasthan. The claims involved were of the value exceeding USD 126 million.
  • Represented a public sector undertaking in an international commercial arbitration proceeding under the ICC Rules of Arbitration in relation to a contract for Design and Construction of Civil, Building and Track works for a double line Railway project. The claim raised by the counter-party was for an amount exceeding INR 254 crores.
  • Representing a Mauritian aviation company in an international commercial arbitration relating to its disputes under the shareholder agreement with the Indian promoters. The value of the claims involved is about INR 700 crores.
  • Representing various construction companies (and joint ventures of Indian and foreign companies) in relation to their disputes with Government Corporations arising out of construction of Metro Rail Projects, Hydro-electric & Thermal Power Plant Projects.
  • Representing multiple Foreign & Indian Private Equity investors in their disputes with the promoters of companies before the National Company Law Tribunal & National Company Law Appellate Tribunal.
