Vishrutyi Sahni, Partner – Disputes, Insolvency and Arbitration at JSA

Vishrutyi Sahni is a Partner in the Disputes practice at JSA with a strong focused on complex commercial disputes at the intersection of insolvency, restructuring, arbitration, technology and platform regulation across multi-agency enforcement. She regularly navigates matters that span multiple fora, regulators, and jurisdictions, advising financial institutions, technology companies and corporate stakeholders on multi-forum strategy, enforcement, and dispute risk in commercially sensitive and cross-border matters.

Vishrutyi regularly acts in commercial disputes, including domestic and international arbitrations (both ad hoc and institutional), as well as litigation arising from contractual arrangements, shareholder relationships, and enforcement actions. She also has significant experience in insolvency and restructuring-related disputes, particularly in the context of distressed assets, recovery actions, and restructuring scenarios. In this space, she advises and represents creditors, lenders, resolution professionals, and corporate stakeholders, and works closely with financial institutions on enforcement, recovery, and restructuring-related litigation.

In parallel, Vishrutyi has developed a focused practice in technology and platform-related disputes, including intermediary liability, content regulation, and regulatory enforcement actions. She advises technology platforms, fintech companies, and technology-led manufacturing businesses on navigating evolving regulatory frameworks, managing enforcement exposure. She has represented and supported Clients in proceedings involving multiple regulators and agencies, including in enforcement and compliance-driven actions before sectoral authorities and specialised forums such as the CCPA, BIS and NGT, as well as proceedings involving pollution control authorities (CPCB/SPCBs), legal metrology and food safety regulators, consumer protection fora.

Her practice also encompasses white-collar and regulatory matters, including internal investigations, allegations of financial irregularities and misconduct, and engagements with investigative authorities. She regularly advises on investigation strategy, regulatory interface, and parallel proceedings arising from such matters. In the present times of an increasing convergence of regulatory oversight across both new-age and traditional industries, she has a growing experience in representing clients before law enforcement agencies such as the Enforcement Directorate, SFIO, EOW and NCB.

Vishrutyi is known for her ability to combine legal strategy with commercial insight, and for working closely with clients to deliver practical, business-oriented solutions in complex and fast-evolving dispute scenarios.

Vishrutyi represents clients in disputes across fora in India, ranging from the Supreme Court and various High Courts to statutory tribunals and regulatory authorities

Prior to JSA, she worked as a judicial law clerk-cum-research assistant to Hon’ble Mr. Justice (Retd.) Madan B. Lokur at the Supreme Court of India.

  • acting for the respondents (majority investors) in a SIAC emergency arbitration involving disputes relating to board control and corporate governance, resulting in a favourable interim order delineating the limits of arbitral intervention in board-level decisions, in collaboration with international counsel on Indian and Singapore law and procedure;
  • representing a Singapore-headquartered multinational banking and financial services corporation in execution proceedings before the Delhi High Court, and in connected proceedings relating to a forensic audit into dealings concerning pledged shares of a listed healthcare company and associated borrower and group entities;
  • successfully representing a leading housing finance company before the Supreme Court of India in a constitutional challenge to the provisions of the Insolvency and Bankruptcy Code, 2016 relating to personal guarantors;
  • representing the Committee of Creditors in the insolvency proceedings of Go Airlines (India) Limited (Go First), including in connected proceedings before the NCLT, NCLAT and the Supreme Court of India, culminating in the liquidation of the airline;
  • representing financial creditors in a series of significant personal guarantor insolvency proceedings, including in relation to the personal guarantors of the Shipra Group and Educomp Group, involving admission into insolvency, replacement of resolution professionals, and interpretation of key provisions of the IBC governing individual insolvency;
  • representing Yatra Online Limited in insolvency proceedings and appellate challenges, including successful defence of proceedings before the NCLAT;
  • advising and representing a private equity nominee director in avoidance and wrongful trading proceedings under Section 66 of the IBC in the insolvency of a technology-driven platform business, including defending parallel criminal proceedings arising from such allegations;
  • representing Indiabulls Housing Finance Limited in a high-value, multi-forum dispute involving loan recoveries exceeding INR 2,300 crores against the Bliss Group of Companies and entities associated with Rana Kapoor, including arbitration proceedings, enforcement actions, and parallel proceedings under the Prevention of Money Laundering Act and before various courts and tribunals;
  • representing a leading e-commerce group company in a high-value commercial arbitration against a public sector insurance company involving claims and counterclaims exceeding INR 250 crores, arising from complex warranty and insurance arrangements;
  • representing leading technology and e-commerce companies in regulatory and enforcement actions, including challenges before various High Courts to orders passed by the Central Consumer Protection Authority in relation to the sale of walkie-talkies on e-commerce platforms and product safety enforcement concerning pressure cookers, as well as proceedings arising from actions of the Bureau of Indian Standards;
  • appearing and representing clients across sectors, including leading e-commerce platforms, consumer electronics manufacturers, mobility platforms and FMCG companies, in enforcement and compliance proceedings before authorities such as the Legal Metrology Department, Food Safety authorities, and Pollution Control Boards (CPCB/SPCBs), as well as in proceedings before the National Green Tribunal;
  • advising the Dawoodi Bohra community before the Joint Parliamentary Committee in relation to the Wakf (Amendment) Bill, 2025.
