Shreya is a multi-disciplinary dispute resolution practitioner, experienced litigator, and Partner at JSA. She brings with her a wealth of experience in Dispute Resolution, Data Privacy, and Technology, Media & Telecommunications (TMT) law, further strengthening the firm’s capabilities in these critical practice areas.

A distinguished legal professional, Shreya Sircar has an impressive track-record in corporate commercial litigation, arbitration, and alternate dispute resolution. She has advised and represented leading transnational and Indian corporates. Her extensive experience spans high-value, complex shareholder disputes, contractual claims, corporate insolvency resolution proceedings, and disputes in the TMT sector. With over 14 years of experience in dispute resolution, Shreya’s prior experience includes roles at leading law firms such as Shardul Amarchand Mangaldas & Co., Luthra & Luthra Law Offices, Bharucha & Partners, and Bhasin & Co. She holds an LL.M. from New York University School of Law, an LL.B. from the University of Delhi, and a B.A. in Political Science (Hons.) from Lady Shri Ram College, University of Delhi.

  • Representing a state-owned industrial corporation in an international arbitration arising out of a contract with a foreign party concerning the grant of certain incentives and tax exemptions.
  • Advising and representing a state-owned industrial corporation in a domestic arbitration against a leading automobile manufacturer in India pertaining to disputes and claims in setting up of a manufacturing plant.
  • Acting for a state-owned industrial corporation in various court proceedings relating to and arising out of arbitrations concerning challenges and enforcement of arbitral awards.
  • Acting for a leading Indian infrastructure finance company/NBFC in its disputes arising out of shareholder’s agreement; and advising and acting for the company in various proceedings under the Insolvency and Bankruptcy Code across Courts and Tribunals in India.
  • Acting for a Private Equity investor in its contractual and shareholder disputes with government backed promoter entities in India’s only PPP water utility in South India.
  • Acting for a leading German company engaged in the manufacture of rubber to metal bonded products in its disputes with the Indian joint venture partner.
  • Acting for a leading gasket manufacturing company of Japan in its contractual and shareholder disputes with the Indian joint venture partner.
  • Representing and advising a leading toner manufacturing company of Japan in its disputes with the Indian joint venture partner.
  • Advised and represented a Maharatna public sector undertaking, in proceedings challenging an arbitral award arising out of ad hoc arbitration in their dispute with the Ministry of Energy & Mining, Government of Sudan arising out of a pipeline contract agreement, for financing and construction of a multi-product pipeline system.
  • Represented leading television network, before the Supreme Court and the NCLAT on issues of Competition law.
  • Advised and represented global FMCG company, in Special Leave Petitions before the Supreme Court, Writ Petitions before the Bombay High Court, and Kolkata High Court, and class action complaints before National Consumer Disputes Redressal Commission.
  • Advised global FMCG company on various regulatory compliances under the FSSAI Act, Rules and Regulations including sampling, testing, packaging, labelling, and advertising compliances.
  • Represented the world’s leading steel and mining company in litigation (in a suit pending before Kolkata High Court) and ICC arbitration, in disputes arising out of shareholder agreements.
  • Advised and represented leading rolling stock and railroad equipment manufacturing company, in mediation and ICC arbitration arising out of procurement, supply, manufacturing, and maintenance agreements.
  • Acted as counsel for Navratna public sector undertakings in ICC arbitrations in London, arising out of disputes related to turnkey contracts for the construction of a power plant in Iraq and exploration plants in Libya.
  • Represented a special purpose vehicle formed between Indian public sector undertakings, and the Government of Mozambique in ICC arbitral proceedings, with Mozambican law as the governing law of arbitration.
  • Represented resolution professionals in high-stake matters before the Supreme Court about one-time spectrum charges / Adjusted Gross Revenue imposed by the Department of Telecommunications.
  • Represented leading car manufacturer in proceedings before the Supreme Court challenging the administrative order passed by the Director General, CCI in its suo moto investigation and constitutional challenge to the vires to the statute. Successfully defended the client before the CCI in cases involving allegations of abuse of dominant position.
  • Advised on Competition Law issues and represented the client before the COMPAT and the CCI regarding allegations of entering into anti-competitive agreements with regional associations.
  • Advised and represented leading Indian multinational trading conglomerate on coal trading, mining, and bunkering disputes before arbitral tribunals and High Courts against State Power Generation Corporations.
  • Represented leading Telecom Service Provider before regulatory and arbitral proceedings concerning the Telecom Regulatory Authority of India’s Interconnection Usage Charge Regulations, various penalty proceedings on spectrum usage charges, license conditions, as well as contractual claims arising under service agreements with passive infrastructure providers.
  • Represented leading Telecom Service Provider in litigation pertaining to the Information Technology Act 2000 and Intermediary Guidelines 2021. Specifically, contesting allegations of breach of sensitive personal data and critical information.
  • Represented leading real estate development companies in several class action complaints before National Consumer Disputes Redressal Commission, appeals before the Supreme Court of India and in proceedings before the Registrar of Societies.
  • Represented leading Engineering, Procurement and Construction company in execution and arbitral proceedings against public sector undertakings.
  • Advised infrastructure development company on employment & labour law issues and invocation of arbitration arising out of transportation and infrastructure projects, as well as third party vendor disputes.
  • Advised and represented leading construction company in Writ Petitions challenging wrongful forfeiture of earnest money by the Madhya Pradesh State Mining Corporation Ltd. under the Madhya Pradesh Sand Mining Policy.
  • Advised household appliances manufacturing company on issues arising under the Legal Metrology Act and subsequent representation before the Karnataka High Court.
  • Represented a facility management company in proceedings defending a successful Arbitral Award. Additionally, periodically review laws, regulations, and guidelines to identify emerging trends in the digital legal landscape in India to support and supervise the client to ensure compliance with the applicable laws on data protection and privacy.
  • Advised and assisted a communications technology network in document disclosure with the Securities Exchange Board of India.
  • Represented a leading business conglomerate in marine services, ports, logistics and technology in insurance claims before the National Consumer Disputes Redressal Commission and Appeals to the Supreme Court of India.
  • Represented a leading luxury car manufacturer in claims before the National Consumer Disputes Redressal Commission and Appeal to the Supreme Court of India.
  • Advised leading global luxury brand, on regulatory compliances for setting-up ecommerce platform in India.
  • Advised UK-based production company on content regulation, production policy, privacy, and defamation laws in India, and supplying on-ground legal support to its production team in India.
  • Acted for large manufacturer of pharmaceuticals (seeking requisite approvals under the Drugs and Cosmetics Act, 1940) and defended proceedings in the phytoceutical and nutraceutical space.
  • Advised a cosmetic product manufacturer, on standard quality and effectiveness of the product, in compliance with the regulatory framework. Additionally, represented the client in defamation, infringement proceedings and in a complaint before the Advertising Standards Council of India.
  • Represented and advised broking companies in relation to claims made by various investors in arbitral proceedings under the National Stock Exchange Byelaws.
  • Represented two private equity funds before the National Company Law Tribunal with respect to matters under the Insolvency and Bankruptcy Code, 2016, and a case under the Companies Act, 2013 for oppression and mismanagement.
  • Represented a leading Financial and Banking Institution before the Supreme Court, National Company Law Tribunal, and NCLAT with respect to an appeal under the Insolvency and Bankruptcy Code, 2016 about its claims under corporate guarantees.
  • Policy participation in drafting guidelines issued by the Department of Consumer Affairs to establish regulatory framework for identifying, preventing, and regulating deceptive practices in advertising and e-commerce to protect consumer interests.
