Saunak is actively involved in the disputes practice of the firm with primary focus in the Infrastructure and Regulatory Litigation which includes Energy (Power and Natural Resources), Environment, Public Procurement, Civil Aviation, Engineering, Procurement and Construction, Public-Private Partnerships etc.

His practice focuses on Drafting of Petitions, Appeals, Rejoinders, Statement of Claims, Applications etc. and Representing the Clients (across practice area) before various fora being Supreme Court of India, different High Courts, Electricity Commissions (Central/State), Appellate Tribunal for Electricity, sector specific Bodies/Authorities, Arbitral Tribunals etc.

He has been involved in several advisories and legal opinions concerning regulatory issues pertaining to Force Majeure, Change in Law, End-Use of Coal by Power Plants, Renewable Energy Certificates and its Trading, Renewable Power Purchase Obligations, Import of Coal, Generation, Distribution, and Transmission of Electricity, sector-specific Reforms, etc. He has critically analyzed the issues arising out of the policies issued by different Statutory Authorities with respect to the practice areas.

Saunak has been a Bar Council of India Trust Scholar [2017]. With a specialization in Constitutional and Administrative laws, he graduated from KIIT School of Law, Bhubaneswar in 2019. He joined the firm in his 10th Semester as a Legal Trainee/Permanent Intern and has been an Attorney with the Firm upon graduation since July 2019.

Saunak has successfully represented the Clients in several precedent-setting commercial and regulatory matters before the Supreme Court, High Courts, Appellate Tribunal for Electricity, Electricity Commissions (Central and States), sector-specific Statutory Authorities etc. Some of the key assignments in these areas handled and being handled by Saunak, amongst others, cover the following: –

  • Successfully represented “Techno Electric and Engineering Company”, a leading Wind Energy generator, before Appellate Tribunal for Electricity in a “first of its kind” matter dealing with the issues concerning mandatory compliance of Renewable Energy Purchase Obligations as pre-condition to Discoms’ eligibility to sell Renewable Energy Certificates.
  • Successfully represented a leading “Adani Power (Mundra) Ltd.” before the Supreme Court in a complex matter of high economic value (approx. 17000 Cr.) pertaining to dues towards Change in Law compensation on account of domestic coal shortfall.
  • Successfully argued for “Adani Power (Mundra) Ltd.” before Central Electricity Regulatory Commission in a case concerning Change in Law reliefs towards basic customs duty.
  • Successfully represented a “Udupi Power Corporation Ltd.” (Adani Group) before Appellate Tribunal for Electricity in a complex matter of high economic value (approx. 1900 Cr.) involving issues of applicability of Limitation Act to a regulatory proceeding, Late Payment Surcharge liability of Discoms etc. This matter is significant due to the peculiar issues settled/having attained finality and the monetary benefit on part of the generator.
  • Successfully argued on behalf of “PepsiCo India Holdings Ltd.” before the Court of Divisional Commissioner, Patiala obtaining stay on a disconnection notice (Electricity).
  • Represented “Abellon Clean Energy Ltd.”, a leading Biomass and Municipal Waste based Power Producer, in its disputes with the Distribution Licensee concerning the issues of Scheduling, Force Majeure, SCoD extension and tariff protection etc. before Supreme Court, Gujarat Electricity Regulatory Commission, Appellate Tribunal for Electricity and High Court of Gujarat.
  • Represented several clients in multiple Tender/Bid related disputes concerning the Infrastructure Sector before different High Courts and the Supreme Court include “India Grid Trust”, “Adani Power” etc.
  • Represented “Rain Calcining Ltd.”, a leading Co-generating Plant, before the Supreme Court and various High Courts in its disputes with Ministry of Commerce, Department of Customs and State Discoms on issues concerning import of Raw Petroleum Coke into India, Environmental Safeguards for Calcining Plants, levy of Wheeling Charges, Grid Support Charges, Electricity Duty etc.
  • Successfully represented “Adani Power Maharashtra Ltd.” in a matter concerning De-allocation of a Captive Coal Block and consequential Change in Law and Force Majeure claims.

 

Saunak is a regular Speaker at different Webinars, Workshops, Panel Discussions and Guest Lectures and has also been actively involved in the Indian and International Mooting circuits. He has judged the Finals, Semi-Finals and Quarterfinal Rounds in over 50 National and International Moot Court, Trial Advocacy and Alternative Dispute Resolution Competitions (Arbitration, Negotiation, Mediation etc.) and has also drafted Moot Court Propositions of several competitions.
