Rishab Aggarwal

Rishab is part of the disputes resolution team at Mumbai. He practices civil and commercial law including banking, intellectual property, and insolvency law along with domestic and international arbitration, and has appeared before High Court, City Civil Court, National Company Law Tribunal, as well as arbitral tribunals.

Rishab graduated from Gujarat National Law University as a gold medallist and is practicing law since 2022. Before joining JSA, Rishab has worked with Khaitan and Co. and Krishnamurthy and Co.

  • Representing and advising a lubricant manufacturing company in dispute against former employee in relation to infringement of intellectual property, including trade secrets, before Hon’ble Delhi High Court.
  • Advising a government department in relation to a sector-specific policy to be adopted and drafting of a report therof.
  • Advising an official liquidator of a chemical manufacturing company in relation to proceedings before Hon’ble Supreme Court and Hon’ble Gujarat High Court, regarding consideration of tax departments as secured creditor and release of liquidation proceeds as deposited with the registry of the court.
  • Represented and advised a leading engineering and manufacturing public sector undertaking in a commercial arbitration before an arbitral tribunal consisting of retired judges from Supreme Court and High Courts, and appeared on their behalf before Hon’ble Bombay High Court in proceedings concerning sections 29A and 27 of Arbitration and Conciliation Act, 1996.
  • Represented and advised a leading public sector bank before National Company Law Tribunal, Mumbai in insolvency proceedings initiated against a corporate guarantor for a loan transaction in relation to construction of residential units.
  • Represented and advised a leading infrastructure development company before National Company Law Tribunal, Ahmedabad, in relation to insolvency proceedings initiated against a vendor.
  • Represented and advised a consortium of lenders before Hon’ble Bombay City Civil Court, Mumbai in proceedings related to declaration of borrower’s account as fraud and red flagged account.
  • Represented and advised group of employees before National Company Law Tribunal, Mumbai in relation to insolvency proceedings sought to be initiated against the company which defaulted in payment of their salaries and other statutory dues.
  • Advised a small finance bank in relation to the interpretation and application of the scheme of amalgamation as prepared by Reserve Bank of India and other day-to-day queries in relation to banking business.
  • Advised an investment group in a dispute against film production company, in relation to their investment in the latter and the consequent non-fulfilment of contractual obligations of releasing the films on time, and initiated the arbitral proceedings before Singapore International Arbitration Centre.
  • Advised a multinational information technology company in a dispute against an entertainment company in relation to unpaid dues for the software migration services so rendered and drafted the application under section 9 of Arbitration and Conciliation Act, 1996 to be filed before the High Court.
  • Advised an online ticketing platform in a dispute with an event management company for alleged non-payment of dues, advised them in the pre-institution mediation proceedings, and further advised them in relation to a proceedings under section 9 of Arbitration and Conciliation Act, 1996 as initiated before Hon’ble Madras High Court.
  • Represented and advised a foreign investment group as a promoter selling shareholder in the initial public offer of a non- banking finance company in India.
  • Represented and advised a chemical manufacturing company on their qualified institutions placement, undertaking diligence of the preliminary placement document and material agreements.
  • Advised a foreign internet platform offering gaming, dating, social streaming and payment products in India through a subsidiary, on drafting the Indian law related disclosures in their offer document.
