Amar Gupta

Amar is amongst the founding members of JSA’s Disputes Practice. He has extensive experience in commercial litigation, arbitration and regularly argues at various fora. He advises and represents key clients and has conducted high profile litigations before the Supreme Court of India, High Courts, National Company Law Tribunals (formerly Company Law Board) of various States, and other Tribunals. Several of the legal proceedings Amar has acted and appeared in, have resulted in landmark judgments reported in reputed journals. Amar is often invited as an expert in his areas of practice in seminars and conferences.  

He also has extensive experience in the conduct of both domestic and international commercial arbitration and is a member of the ICC Commission on Arbitration and ADR, the Executive Committee of ICC India, and Indian Council of Arbitration. 

Amar is also focusing on recently introduced Insolvency Law. He argued key issue of interpretation at the early stage of development of jurisprudence on the subject. He has represented and advised Financial Creditors, Operational Creditors as well as Resolution Professionals.  

Amar also has expertise in Environmental Law and has conducted proceedings before National Green Tribunal and its Benches on behalf of the industries. 

Amar has a diverse practice area comprising of disputes arising in relation to JV Agreements & Franchise Agreements - both International and Domestic; Shareholders’ Agreements, Share Purchase Agreements; Infrastructure projects related to Telecom, Oil & Gas, Power; Banking & Finance transactions including Letter of Credit & bank guarantees; and Indirect Tax against revenue authorities. He has also undertaken Tort actions; Criminal proceedings arising from Commercial transactions; Corporate law matters including Restructuring, and Mergers & Acquisitions.

  • ATC Telecom Infrastructure Private Limited in contractual disputes with their customers and business partners; and in regulatory proceedings
  • Reckitt Benkiser, successfully defended an anti-suit injunction against its group company
  • West Bengal Industrial Development Corporation in disputes with a prominent venture capitalist pertaining to management and control of one of the major petrochemicals company in India, Haldia Petrochemicals Limited in foreign international commercial arbitration before International Chambers of Commerce (ICC), Paris, France
  • AB InBev (Anheuser-Busch InBev) in a suit by a business partner challenging the termination of an agreement and for damages
  • Power Finance Corporation Limited in its Petition for initiating Corporate Insolvency Resolution Process against East Coast Energy Private Limited
  • BP Exploration (Alpha) Ltd. in multiple proceedings before the Supreme Court of India in relation to disputes/issues arising out of a Production Sharing Contract entered with the Government of India
