Abhishek Munot

Abhishek specialises in handling sector specific commercial litigation, constitutional & administrative law litigation and regulatory proceedings before statutory authorities, tribunals and courts. He anchors JSA’s regulatory practice in Mumbai and has appeared as a counsel in several commercial & regulatory matters before the High Courts, Appellate Tribunals and Regulators. 

His practice covers diverse aspects of commercial, regulatory and civil litigation. He has handled varied matters in courts and tribunals relating to commercial & general civil litigation involving statutory and contractual aspects of civil laws. 

Abhishek has handled various aspects of dispute resolution including domestic and international arbitrations. He has advised on applicable constitutional, legal, policy and regulatory issues, including delegated legislation, policies and regulatory instruments. He is regularly consulted by several large corporations like the Tata Group, the Essar Group, the Shapoorji Pallonji Group, the Torrent Power Group, Adani Power, K. Raheja and Sterlite Technologies, to name a few. 

Abhishek has anchored certain path-breaking and unprecedented matters which have had a direct impact on India’s energy sector. Some of these matters include:

  • Anchored the brief for CGPL, a USD 4 billion project, before CERC, APTEL and Supreme Court regarding its claim for compensatory tariff to offset the hardship caused by unprecedented, unforeseen and un-absorbable price spiral of imported coal 
  • Grant of parallel distribution licence to Tata Power in Mumbai district and Mumbai Suburban areas. As an outcome of the Petitions / Applications and Appeals, Tata Power was granted a parallel distribution licence to supply electricity in Mumbai for a period of 25 years from 15 August 2014 
  • Successful operation of parallel distribution licensing provisions, under the Electricity Act, is unique to the city of Mumbai
  • Abhishek’s advisory on this matter dealt with complex issues qua requirements for grant of parallel licence, rolling out of parallel network and grant of ‘open access’ in parallel licence scenario 
  • Abhishek’s team has challenged the levy of parallel operation charges/ grid support charges applicable on captive power plants operating in parallel with the grid. This is a first-of-its-kind challenge and has a direct impact on industries setting up captive power plants in India 
  • Advised infrastructure companies on certain complex issues relating to the implementation of their Concession Agreement with National Highway Authority of India
