Tabish Samdani, Associate, JSA

Tabish Samdani is a lawyer in the Dispute Resolution team of J. Sagar Associates (JSA). He specialises in banking and securities disputes, corporate commercial disputes and commercial arbitrations. He handles varied matters before the Hon’ble Supreme Court of India, Hon’ble Gujarat High Court, Hon’ble National Company Law Tribunal, Hon’ble Debt Recovery Tribunal and Hon’ble Arbitral Tribunals.

He regularly advises on complex litigations and multi-jurisdictional disputes. He has advised and represented multi-national and domestic clients before various domestic and international arbitral tribunals (both institutional and ad-hoc) including tribunals constituted under the aegis of ICC, SIAC, LCIA etc. He has in-depth knowledge and understanding of commercial and investment arbitrations covering a vast array of issues.

He has been practicing law since 2015. Before joining JSA, he was working as in-house counsel for a real estate company.

Some of the key assignments being handled by Tabish include:

  • Advised and assisted Safal Constructions Private Limited, Ahmedabad, and its affiliates (BSafal Group) in connection to its 50:50 joint venture with Phoenix Mills Limited, Mumbai (PML) to develop a premium retail development in Ahmedabad under the brand “Palladium Mall”. Both the parties will invest around Rs. 230 crores each for their 50% stake in the joint venture. The JV entities involved in this transaction are SGH Realty LLP, True Value Infrabuild LLP, Zaveri and Company Private Limited, Ausom Enterprise Limited and KIFS Infrastructure LLP.
  • Representing two pharmaceutical companies in an ICC arbitration, on account of breaches by the Respondents of the Non-Compete and Non-Solicitation obligations, agreed under the Restated Combined Share Purchase Agreement (“SPA”). The breaches by the Respondents had caused the Claimants sizable loss and damage running into several hundreds crores of rupees.
  • Representing India’s largest Cement Manufacturer and the second largest Oil Refinery in separate writ petitions before the Gujarat High Court, challenging the unlawful levy/ recovery of Parallel Operation Charges by the Gujarat State distribution licensees.
  • Represented a reputed educational institution before the Gujarat High Court challenging withdrawal of affiliation by the Central Board of Secondary Education (“CBSE”), cancellation of State recognition by the District Primary Education Officer (“DPEO”) and take-over of the School’s administration by the District Education Officer (“DEO”).
  • Represented Daimler AG commonly known as Mercedes, a multinational automotive corporation before the Gujarat High Court in a Civil Revision Application for rejection of Plaint under Order VII Rule 11.
  • Representing a professional doctor before the Gujarat High Court in an appeal filed by the hospital against the order of the Commercial Court upholding the arbitral award passed by the learned arbitrator.
