Girik Bhalla, Associate, JSA

Girik primarily focuses on Regulatory & Policy and Dispute Resolution in Electricity and Renewable Energy.

He appears before diverse fora namely, Supreme Court of India, High Courts of various States, Appellate Tribunal for Electricity, Central Electricity Regulatory Commission and other State Electricity Regulatory Commissions.

He is involved in various aspects of Regulatory Dispute Resolution including formulating strategies, drafting petitions, appeals, replies, rejoinders etc. on issues such as tariff fixation, licensing, billing disputes, scheduling and despatch for generation and transmission companies.

Prior to joining JSA, he was working with a Senior Advocate at the Supreme Court of India wherein he was extensively working on insolvency laws, real estate and arbitration in the infrastructure sector.

Some of the key assignments in these areas handled and being handled by Girik amongst others, cover the following:

  • Represented renewable energy based power companies before Hon’ble High Court of Andhra Pradesh in proceedings pertaining to unilateral reduction in wind tariff by Government of Andhra Pradesh and Andhra Pradesh Distribution Companies. Actions of the Government had put a portfolio of about 5000 MW privately owned renewable power capacity in jeopardy.
  • Drafted and filed a writ petition on behalf of various thermal power producers before Hon’ble High Court of Delhi challenging the constitutional validity of Para B(iii) of SHAKTI and Scheme Document for Auction of Coal Linkages to Power Producers/IPPs without PPAs issued by Coal India Ltd. The policies were challenged as being violative of Article 14 (discriminatory and arbitrary) and Article 19(1)(g) (distorted level playing field) of the Constitution and as being ultra vires the Electricity Act.
  • Represented GVK Bagodara Vasad Expressway Private Limited in arbitration proceedings against Gujarat State Road Development Corporation. The proceedings relate to the termination of the Concession Agreement for six laning of the Baghodara – Vasad State Highway.
