Rahul Kinra, Principal Associate, JSA

Rahul is a part of the Disputes team at JSA. He primarily focuses on regulatory proceedings before statutory authorities, tribunals and courts.

He has been advising clients and rendering legal opinion on regulatory issues relating to power sector including tariff fixation and categorisation, suspension of license, insolvency proceedings, abuse of dominance by generating company, renewable purchase obligations, parallel licensing, open access, connectivity, banking, cross subsidy surcharge, power trading, demand side management, power allocation from a generating company, electricity reform & restructuring (including segregation of distribution sector into wires and retail supply business), safety aspects involving electrical installations and employee related issues.

He has represented private distribution companies and solar power developers before the Supreme Court of India, High Court of Delhi, Appellate Tribunal for Electricity, Central & State Electricity Regulatory Commissions, National Company Law Tribunal, National Company Law Appellate Tribunal and District Courts.

Rahul has been working with the Disputes team in JSA since 2013, after graduating with a specialised degree in energy laws.

Some of the key assignments in these areas handled and being handled by Rahul amongst others, cover the following:

  • He was part of the team involved in the restructuring of Electricity Distribution Board in the State of Manipur.
  • Successfully challenged the powers of Comptroller & Auditor General to audit a private distribution company (Discom) before the Division Bench of the High Court of Delhi.
  • Successfully challenged National Green Tribunal’s Orders directing collection of environmental compensation in Electricity consumption bills issued by distribution Companies in the NCT of Delhi.
  • Successfully challenged Karnataka Electricity Regulatory Commission’s Order before Appellate Tribunal, for a Solar Developer, which imposed Wheeling and Banking charges on solar projects which were earlier exempt from such charges for a period of 10 years from date of their Commercial Operation.
  • Successfully defended Petition filed by Central Generating Station (CGS) before Central Electricity Regulatory Commission (CERC) for Discoms seeking relaxation of the Normative Annual Plant Availability Factor for shortage of coal. CERC rejected prayer of CGS.
  • Successfully defended all the three Discoms in the NCT Delhi in a PIL seeking reduction of Fixed Charges and Revision of Contract Demand. The PIL was dismissed by the Hon’ble High Court of Delhi.
  • Instrumental in policy advocacy and filing of Petitions for Solar developer in various states seeking banking for the useful life of the project i.e. 25 years as well as issuance of Wheeling and Banking Agreements.
  • Successfully sought stay from the Appellate Tribunal on the penalty imposed by Delhi Electricity regulatory Commission on a Discom for alleged non-compliance of Renewable Purchase Obligation.
