Arjun Krishnamoorthy, Senior Associate, JSA

Arjun is part of the Life Sciences, Healthcare and Pharma practice, with a focus on commercial contract advising (including service agreements, franchising agreements, and employment and consultancy contracts), M&A, regulatory compliances, data protection, and real estate matters.

He advises on various aspects of health laws, including contract manufacturing, medical devices, and sale of pharmaceutical products and data protection.

Arjun has also advised on regulatory matters under the Drugs and Cosmetics Act, 1940, including on manufacturing and import licenses, and the Narcotic Drugs and Psychotropic Substances Act, 1985, including on manufacturing and import licences.

He has also assisted companies with the potential launches of their products in India, rendering advice under Indian laws that pertain to medical devices, as well as pharmaceutical products.

Arjun also has experience in advising companies in relation to data privacy, data storage, surveillance, liability of intermediaries, data breaches and reporting of cybersecurity incidents, as well as cross-border transfer of data including transfer impact assessments.

Arjun has also assisted companies in relation to media streaming and related copyright matters.

As part of the Telecommunications and Broadcasting practice, Arjun has advised companies on the setting up of data centres in India, including assisting with the acquisition of land for such purpose. He has also been advising companies on satellite communication related matters.

Arjun has been a practicing attorney since 2005, and worked at Kochhar & Co., at the firm’s Bangalore office till 2012. Prior to joining JSA, Arjun read for his doctorate, specializing in medical law.

Some of the key assignments in these areas handled and being handled by Arjun amongst others, cover the following:-

  • Advised and assisted a leading biopharmaceutical company in reproductive medicine and women’s health, in (a)undertaking contract manufacturing in India under a loan license; (b) the Drugs and Cosmetics Act, 1940 including on the Medical Devices Rules.
  • Assisted a leading biotechnology company focusing on the research and development of industrial enzymes and biopharmaceutical ingredients in setting up their manufacturing unit in India.
  • Advised Apple on the launch of maternity health tracking apps in India.
  • Advised Pureform Biologicals on the potential launch of CBD/cannabis-based products in India.
  • Advised BODE Chemie GmbH in relation to the licenses required under Indian laws (including whether to consider the product as a drug or a medical device) for sale of their product ‘Sterillium’ in India
  • Advising and assisting a Government of India public sector undertaking in relation to the acquisition of communication satellites from the Department of Space.
  • Advised OneOTT Intertainment Limited, a video and broadband service provider, in relation to the potential launch of their broadband over satellite and other satcom services.
  • Advised Spotify in relation to the provisions of statutory licenses and related copyright matters in relation to their streaming services in India.
  • Advised and assisted Teleperformance SE, on the India leg of the transaction, with the acquisition of Intelenet group of companies from Blackstone; with a deal value of approximately USD 1 billion.
  • Advised and assisted Baring Private Equity Asia in the acquisition of IT services firm, Virtuasa Corporation.
  • Advised and assisted a leading global provider of trading, clearing, exchange technology, listing, information and public company services, on the India leg of the transaction, with the sale of its public relations solutions and digital media services business; with a deal value of approximately USD 335 million.
